Demand : There are approximately 12,000 practicing doctors in Malaysia, half of whom are in private practice. Very rarely is a doctor in private practice employer-indemnified. Furthermore, an increase in the level of Medicolegal activity is being experienced globally, which can be attributed to various factors; increasing educational sophistication of society at large, changing perception of patients' rights, information dissemination, the Internet, and a growing willingness to resort to legal action against large hospitals in order to settle medical disputes.

Mismatch : Malpractice liability premiums from Malaysia have over the years been subsidising overseas-based medical litigation systems , which collect sizeable premium payments annually from GP's and medical specialists in Malaysia. This is against a comparatively low claims background. It has become clear from research data obtained by the founders of MDM Bhd, that there is a mismatch between premiums and claims in Malaysia. This discrepancy is another area which MDM Bhd hopes to address with its basic philosophy.

Efficiency : From the international experience studied, it has become clear that vigorous management of the costs of malpractice litigation appears to be the key to any improvement of the malpractice claims scenario. MDM Bhd will set up an in-house medico-legal panel drawn from credible local expertise. This panel will review each case on its merits, before considering whether or not the claim should be defended.
